These Terms of Service ("Terms") govern your access to and use of www.polymaker.com and any localized versions operated under the Polymaker brand (collectively, the "Site").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

Polymaker sells 3D printing filaments, 3D printing equipment, accessories, and related services via the Site.

2. Eligibility & User Accounts

You must be at least 18 years old or the age of majority in your country to create an account.
Minors may only use the Site under the supervision and consent of a parent or legal guardian.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
Polymaker reserves the right to suspend or terminate accounts that violate these Terms or applicable law.

3. Privacy & Data Protection

Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, store, and share personal data.

Polymaker complies with applicable data protection laws, including:

GDPR (EU) and UK GDPR
UK Data Protection Act 2018
PIPEDA (Canada)
Applicable U.S. federal and state privacy laws

Where required by law, users have rights including access, correction, deletion, portability, and objection to processing. Details are provided in the Privacy Policy.

4. Electronic Communications

By using the Site or contacting us electronically, you consent to receive communications from Polymaker electronically. These communications satisfy legal requirements for written notices where permitted by law.

5. Products, Pricing & Orders

Prices are displayed in applicable local currencies where available.
Taxes, VAT, customs duties, and import fees may apply depending on destination and are the responsibility of the customer unless stated otherwise.
Polymaker reserves the right to refuse or cancel orders, including in cases of pricing errors, suspected fraud, or stock limitations.

6. Shipping, Returns & Refunds

Shipping terms, return conditions, and refund eligibility are set out in our Return & Refund Policy, which forms part of these Terms.

EU & UK Right of Return

If you are a consumer located in the European Union or United Kingdom, you have a statutory right to return your order within 14 days of receiving the goods and receive a refund, without giving any reason, subject to applicable legal exceptions.

Refunds will be issued in accordance with EU Directive 2011/83/EU and UK consumer law.

7. Statutory Warranties (EU & UK)

For consumers located in the EU and UK, Polymaker provides goods in conformity with applicable law, including:

EU Directive (EU) 2019/771 on the sale of goods
UK Consumer Rights Act 2015

These statutory rights apply in addition to any commercial warranties and cannot be excluded or limited.

8. Loyalty Program – Polycoins

Participation in the Polymaker Loyalty Rewards ("Polycoins") Program is subject to these Terms and any additional program rules published on the Site.

One account per individual
Points are non-transferable and have no cash value
Polymaker may modify or terminate the program at any time, subject to applicable law
Fraud, abuse, or misuse may result in forfeiture of points and account termination

9. Acceptable Use & Intellectual Property

All Site content, including text, images, graphics, logos, software, and trademarks, is owned by or licensed to Polymaker and protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, reverse engineer, or commercially exploit Site content without prior written permission.

10. User Submissions

By submitting content (including reviews, feedback, or suggestions), you grant Polymaker a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with its business.

You represent that you have the necessary rights to submit such content.

11. Community & Communication Features

Where interactive features are available, users must not post content that is unlawful, defamatory, abusive, misleading, or infringing.

Polymaker may remove content or restrict access at its discretion.

12. Third-Party Services & Links

The Site may contain links to third-party websites or services. Polymaker is not responsible for third-party content, terms, or practices.

13. International Use

The Site is operated globally. Users are responsible for compliance with local laws applicable in their jurisdiction.

14. Disclaimers

To the maximum extent permitted by applicable law, the Site and products are provided "as is" and "as available".

Nothing in these Terms excludes or limits statutory consumer rights that cannot be waived under applicable law.

15. Limitation of Liability

To the maximum extent permitted by law, Polymaker shall not be liable for indirect, incidental, or consequential damages.

For consumers in the EU, UK, and Canada, this limitation does not apply to liability that cannot be excluded under mandatory consumer protection laws, including liability for death, personal injury, fraud, or defective products.

16. Indemnification

You agree to indemnify and hold harmless Polymaker from claims arising from your breach of these Terms or misuse of the Site, to the extent permitted by law.

17. Governing Law & Dispute Resolution

United States

For users located in the United States, these Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.

Canada

For Canadian consumers, these Terms are governed by applicable provincial consumer protection laws.

EU & United Kingdom

If you are a consumer in the EU or UK:

You may bring legal proceedings in your country of residence
Mandatory arbitration and class-action waivers do not apply where prohibited by law
Local consumer protection laws prevail in case of conflict

18. Termination

Polymaker may suspend or terminate access to the Site for violations of these Terms or applicable law, subject to mandatory consumer protections.

19. Severability & Entire Agreement

If any provision is found unenforceable, the remaining provisions remain in effect.

These Terms constitute the entire agreement between you and Polymaker regarding use of the Site.

20. Changes to These Terms

Polymaker may update these Terms from time to time. Updates become effective upon posting to the Site.
